Terms of service
The agreement between you and us: what the service does, what you may monitor, and where the limits are.

These terms are an agreement between Apostrof SRL ("Pinger", "we", "us"), a company registered in Romania under number 15735302, VAT number RO15735302, with its registered office at Bucharest, and the person or organisation using the service ("you").
By creating an account you accept them. If you are accepting on behalf of a company, you confirm you are allowed to.
What the service does
Pinger checks websites, endpoints and APIs you nominate on a schedule you choose, records what it finds, and notifies you when something changes or fails.
It is a monitoring tool. It observes; it does not repair, protect or guarantee anything about the sites it watches.
Your account
You are responsible for what happens under your account, including anything done by people you invite to it. Keep your credentials to yourself and tell us at office@apostrof.ro if you think somebody else has them.
You must give us an accurate email address and keep it working. Almost everything important we have to tell you — an outage on your site, a failed payment, a change to these terms — arrives by email.
You must be at least 18, or old enough to enter a contract where you live.
What you may monitor
You may only monitor a URL if you own it, operate it, or have permission from whoever does.
A monitor is an instruction to fetch a URL repeatedly from our infrastructure, which is worth abusing. You must not use Pinger to:
- probe a system you have no right to probe;
- generate load intended to degrade or take down a service, yours or anybody else's;
- reach hosts on private, loopback or link-local addresses, or otherwise use our network as a route into somewhere it cannot reach directly;
- circumvent a rate limit, an access control or a block placed on you by the site being monitored;
- store, transmit or fetch anything unlawful.
We validate every outbound URL and re-validate it after each redirect. Attempts to defeat those checks are a breach of these terms, not a bug to be worked around.
We may suspend a monitor, or an account, that we reasonably believe is being used this way. We will tell you why.
Fair use
Plans are sold with explicit limits — how many monitors, how often they run, how many places each can alert. Those limits are the fair-use policy; there is no separate one hiding behind them.
If your usage is inside your plan's limits but still imposes a disproportionate cost on our infrastructure, we will contact you and work something out before we take any action.
Availability
We work to keep Pinger running and we monitor it the same way you monitor your own sites.
We do not offer a service-level agreement with credits or guaranteed uptime on any current plan. Maintenance, provider failures and internet weather all happen, and a monitoring service that promised otherwise would be making a promise it cannot keep. If you need a contractual availability commitment, write to office@apostrof.ro and we will talk about it.
Alerts are best effort
We will make a reasonable effort to deliver every alert, promptly, through the channels you configure.
We cannot guarantee delivery. Email is filtered, webhooks time out, third-party services have outages, and phones are on silent. Do not rely on Pinger as the only way you would find out about a critical failure. Where an outage would cause you serious harm, keep a second, independent means of detection.
Alerts are also deliberately conservative: a single failed probe never notifies. A failure has to reach your monitor's threshold and be confirmed by a further probe before an incident opens. That is a design decision to avoid crying wolf, and it means a very short blip may not produce an alert at all.
Payment
Prices are shown on the pricing page and in your billing settings, exclusive of VAT. VAT is calculated at checkout from your country and, for business customers in the EU, your VAT number.
Subscriptions renew automatically — monthly or yearly, whichever you chose — until you cancel. You can cancel at any time from the billing portal, and your plan keeps working until the end of the period you have already paid for.
If a payment fails we will email you and keep monitoring for a grace period before the account moves down to the free plan. Nothing is deleted when that happens; see Refunds and cancellation.
We may change prices. Existing subscribers get at least 30 days' notice by email, and a change never applies to a period already paid for.
Your data
You keep ownership of everything you put into Pinger and everything we record about the sites you monitor. We process it to run the service and for nothing else.
What we collect, how long we keep it and who else touches it is set out in the Privacy policy. Where we process personal data on your behalf, the Data processing agreement applies and forms part of these terms.
We do not sell your data, and we do not use the contents of your monitored responses to train anything.
Ending the agreement
You can close your account at any time. Write to office@apostrof.ro and we will delete it, subject to the retention obligations described in the Privacy policy.
We can end this agreement if you materially breach these terms and do not fix it within 14 days of us asking, or immediately if the breach is one that cannot be fixed — using the service to attack somebody, for example. If we ever discontinue Pinger entirely, we will give at least 90 days' notice and let you export your data.
Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that: we are not liable for indirect or consequential loss, for lost profit, revenue or business, or for loss arising from an alert that was late, missed or wrong. Our total liability in any twelve-month period is limited to what you paid us in that period.
This is a monitoring tool costing a few euros a month. It is not an insurance policy for the systems it watches, and it is not priced as one.
Changes to these terms
We may update these terms. If a change materially affects your rights we will email you at least 30 days before it takes effect, and the date at the top of this page always tells you when it last changed. Continuing to use Pinger after a change means you accept it.
Law and disputes
These terms are governed by Romanian law, and the courts of Romania have jurisdiction.
If you are a consumer, this does not take away rights you have under the law of the country you live in, and you may also use the European Commission's online dispute resolution platform.
